Data Management

Our experience in dealing with large clients in multiple industries tells us there is an underlying issue with the way in which corporations manage their business records. Nearly all regulated corporations have the concept of information classification, and implement associated data management policies and procedures, such as retention and disposition, with varying degrees of success. However, most organizations are unable to identify specific business records and specify the rules governing their creation, use, storage, and disposition.  Solving this challenging problem is paramount to a successful eDiscovery program. For this reason, Data Management is one of the first places we assist our clients.

Identification

Knowing where potentially responsive information can be found is paramount to a successful eDiscovery effort.  However, most corporations have only a rudimentary understanding of where their data resides, and most of that understanding comes from those systems that form the core of their business.  What about the information that lives outside of those corporate systems?  Surely that information is as potentially responsive as other, more structured information.

Preservation and Collection

Preservation of electronically stored information is a complicated and continually changing concept. The duty to preserve is triggered whenever litigation or an investigation is reasonably anticipated.  Upon this triggering event a litigation hold process must be put in place and standard archival and disposition processes must be halted for potentially responsive information.
