Rule 26(f) of the Federal Rules of Civil Procedure
(FRCP) specifies timing of pre-trial discovery conferences and
responsibilities of parties involved in litigation.
Section 26(f)(1) calls for the parties to confer "as soon as
practicable" to consider, among other requirements, any issues about
preserving discoverable information. The parties must also develop
a proposed discovery plan that oulines the scope of
discovery, forms of production, and timing associated with discovery
process. Mistakes during the pre-trial conference phase of
litigation can be easy to make and can be accompanied by significant
consequences including sanctions and adverse inference instructions.
Planning for Discovery

- Calculating the true cost associated with retaining, retrieving,
and producing ESI to aid in the development of cost-burden arguments
- Assessing client's capability and readiness to produce all
requested ESI in a timely manner
- Supporting the proactive and matter-specific efforts of client's
IT and Legal teams
